2. About Our Services
Highway Heroes is a roadside recovery service proudly serving Alabama and Mississippi, available 24 hours a day, 7 days a week. Our services include, but are not limited to:
• Flat Tire Change: We swap your flat tire for your spare so you can get back on the road safely.
• Battery Jump Start: We jump start your vehicle when you have a dead battery.
• Fuel Delivery: We bring fuel directly to your location when you run out of gas.
• Lockout Service: We safely unlock your vehicle when you are locked out, without causing damage.
• Battery Replacement: We can install a new battery on the spot when a jump start is not sufficient.
• Winch-Out Service: We pull your vehicle out safely if it is stuck in a ditch, mud, snow, or other terrain.
• Accident Scene Standby: We provide on-scene standby assistance at accident locations.
Important: Highway Heroes does not offer towing services. Our focus is on providing non-towing roadside emergency assistance to get you back on the road quickly without the need for a tow truck.
3. Service Area and Availability
Highway Heroes serves customers throughout Alabama and Mississippi. Our services are available 24 hours a day, 7 days a week, including holidays. Response times may vary based on location, weather conditions, traffic, and demand. While we strive to respond as quickly as possible, we do not guarantee specific arrival times.

4. Eligibility
To use Highway Heroes’ services, you must:
• Be at least 18 years of age, or have authorization from a parent or legal guardian.
• Provide accurate and complete information when requesting service, including your name, location, vehicle description, and the nature of your roadside issue.
• Be the owner of the vehicle or have authorization from the vehicle owner to request service on the vehicle.
• Be located within our service area (Alabama and Mississippi) at the time of the service request.
5. Pricing and Payment
5.1 Service Fees
Service fees vary depending on the type of service, your location, and other factors. Pricing information may be provided upon request when you call our service line. Highway Heroes reserves the right to adjust pricing at any time without prior notice. Any price quotes given by phone or text are estimates and may be subject to change based on on-site conditions.
5.2 Payment
Payment is due at the time of service unless otherwise agreed upon in writing. We accept the payment methods disclosed at the time of service. You agree to pay all fees and charges associated with your service request.
5.3 Cancellation
If you cancel a service request after a Highway Heroes technician has been dispatched, you may be charged a trip fee or cancellation fee. Details regarding cancellation fees will be provided upon request.
6. Customer Responsibilities
When using our services, you agree to:
• Provide a safe and accessible environment for our technicians to perform services.
• Remain with your vehicle or at the service location unless otherwise arranged.
• Inform our team of any known hazards, vehicle conditions, or special circumstances that may affect the delivery of service.
• Ensure that you have legal authority over the vehicle for which you are requesting service.
• Treat our technicians with respect and refrain from abusive, threatening, or hostile behavior. Highway Heroes reserves the right to refuse or discontinue service if a customer engages in threatening or inappropriate conduct.
7. Limitation of Services
Highway Heroes provides roadside recovery assistance only. We do not provide:
• Towing services of any kind.
• Mechanical repair or diagnostic services beyond the roadside services listed in Section 2.
• Guarantees that our services will resolve all vehicle issues. Some vehicle problems may require professional mechanical repair or towing by a third-party provider.
Our technicians will make reasonable efforts to assist you, but certain situations (such as severely damaged vehicles, unsafe conditions, or mechanical failures beyond the scope of roadside assistance) may be outside the scope of our services.

ROADSIDE RECOVERY SERVICES ARE PROVIDED ON AN “AS IS” BASIS. WHILE OUR TECHNICIANS WILL MAKE REASONABLE EFFORTS TO ASSIST YOU, WE DO NOT GUARANTEE THAT OUR SERVICES WILL RESOLVE YOUR VEHICLE ISSUE OR THAT YOUR VEHICLE WILL BE OPERATIONAL FOLLOWING SERVICE.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL HIGHWAY HEROES, ENLIGHTENED & E11EV8ED, LLC, ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, TECHNICIANS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
• YOUR USE OF (OR INABILITY TO USE) OUR WEBSITE OR SERVICES;
• ANY DAMAGE TO YOUR VEHICLE OR PROPERTY ARISING FROM OR RELATED TO THE PERFORMANCE OF ROADSIDE SERVICES, EXCEPT WHERE CAUSED BY OUR GROSS NEGLIGENCE OR WILLFUL MISCONDUCT;
• ANY DELAY IN RESPONSE TIME OR INABILITY TO PROVIDE SERVICE;
• ANY CONDUCT OR CONTENT OF ANY THIRD PARTY; OR
• UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT YOU PAID TO HIGHWAY HEROES FOR THE SPECIFIC SERVICE GIVING RISE TO THE LIABILITY, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

You agree to indemnify, defend, and hold harmless Highway Heroes, Enlightened & E11ev8ed, LLC, its owners, officers, employees, agents, technicians, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with:
• Your use of the website or our services;
• Your violation of these Terms;
• Your violation of any law or the rights of any third party;
• Any misrepresentation regarding vehicle ownership or authorization; or
• Any service performed at your request.
